Life throws curveballs, and sometimes, we need someone to step in and handle our affairs when we can't. That's where a power of attorney (POA) comes in. But before this legal document grants authority to your trusted agent, it needs a crucial step: notarization. So, how do you navigate the process seamlessly? Relax, friends, Mobile Notary St. Louis is here to guide you through the maze!
First things first:
- Understand the different POA types: General, limited, medical, and durable are the main players. Choose the one that best suits your situation.
- Obtain a POA: POA's can be obtained from almost anywhere now. You can search online for the particular POA that suits the needs and download and print it, possible for free or for a fee.
- Consult an attorney: The guidance of an attorney helps ensure your POA addresses your specific needs. This is helpful for people that have a more complex situation or a large estate to deal with.
- Get your document ready: Check if it requires specific witnessing requirements or signatures.
- If you are in search of a full Estate Plan, including a Trust and or Will, we have a partnership that provides a deep discount to accessing a Trust or Will

Be sure the signer is ready and capable:
- The person signing the POA must be capable of understanding what it is that they are signing. They must be able to clearly convey this to the Notary without coercion.
- Signer must have a CURRENT (non-expired) valid state (any state) issued ID, Drivers License, or Passport. If this is not available - see below for information on "Credible Witnesses"
- Is signer physically capable of signing on their on free will? If a person has had a stroke or has physical limitations to signing - see below for information on "Credible Witnesses"
Are Witnesses Required on your POA?
If witnesses are required on your particular POA, you will see spaces for witness information and/or witness signatures on the last couple of pages of the document, near the signature areas for the Agent and Notary. If you do not see this here, it likely is not required for your document.
Witness Requirements:
- Witnesses can NOT be mentioned in or related to anyone mentioned in the document
- The best witnesses are a family friend, neighbor or co-worker
- Witnesses MUST be physically present for signing and have a valid state ID, Drivers License or Passport available- no copies or pictures accepted
- Nurses, medical staff or administrative employees will NOT sign as witness to any type of documents that aren't 100% medical related. Do not assume that medical staff will assist because 'someone' told you they can
- We can provide witnesses for an additional fee if you do not have anyone available - arrangements must be made before scheduling appointment online - please call to arrange and inquire about witness fees, let us know if you will need us to supply one or two witnesses 636-293-4493
Credible Witnesses:
If a signer does not have a current ID/Drivers License/ Passport available, the state of Missouri allows for use of what is called "Credible Witnesses".
Credible Witness Requirements:
- Two people that are willing to swear to personally knowing the signer to be who they say they are
- Must have their own current ID/Drivers License/Passport to present to Notary
- Must be physically present for notary appointment
- Must be willing to take an oath (swear to the fact) that they do indeed know the signer to be who they say they are
- Can not be mentioned in the documents or stand to gain from documents being signed
- If any documents being signed also require witnesses for the document, "Credible Witnesses" may also sign as regular witnesses
